Employment-Based Permanent Residency (Green Cards)
Employment-Based Permanent Residency (Green Cards)
Employment-based permanent residency is one of the most common ways immigrants obtain a Green Card. U.S. Citizenship and Immigration Services (USCIS) offers several employment-based categories that allow foreign nationals to live and work permanently in the United States—often with eligibility extended to spouses and children. For many immigrants, this path also leads to U.S. citizenship.
Employment-Based Green Card Categories
EB-1 – Priority Workers
For individuals with extraordinary ability in sciences, arts, education, business, or athletics; outstanding professors or researchers; and certain multinational executives or managers. Some applicants may self-petition, while others require a U.S. employer sponsor.
EB-2 – Advanced Degree or Exceptional Ability
For professionals with advanced degrees or exceptional ability in sciences, arts, or business. This category also includes applicants seeking a National Interest Waiver (NIW), which removes the labor certification requirement when the applicant’s work benefits the U.S.
EB-3 – Skilled Workers, Professionals, and Other Workers
For individuals with at least two years of training or experience, professionals with a bachelor’s degree, or workers performing unskilled permanent labor. A labor certification and full-time job offer are required.
EB-4 – Special Immigrants
Includes religious workers, special immigrant juveniles, certain government employees, members of the U.S. armed forces, translators for the U.S. government, and other designated groups.
EB-5 – Immigrant Investors
For investors who make a qualifying investment in a U.S. business that creates at least 10 full-time jobs. Minimum investment amounts vary based on location. No labor certification is required.
Employment-based immigration laws are complex, and each category has specific requirements. Speaking with an experienced immigration attorney can help you determine the best path toward permanent residency and ensure your application is properly prepared.
